1. Terms and Conditions

Project Agreement

  • All projects begin with a signed agreement outlining the project’s scope, deliverables, and payment schedule.
  • Any additional features, changes in scope, or modifications requested by the client will incur additional charges based on the level of effort required.

Client Responsibilities

  • Clients are responsible for providing timely access to necessary resources, including content, images, and design preferences, to avoid project delays.
  • Approval of milestones and prompt payments are required to maintain the project timeline.

Intellectual Property

  • MARKS MEDIA retains ownership of all source files, design concepts, and code until full payment is received.
  • Upon final payment, intellectual property rights are transferred to the client, except for third-party licenses or components used in the project.

Project Delays

  • MARKS MEDIA is not responsible for delays caused by the client, including late approvals or lack of required resources.
  • Any delay in payment beyond the specified due date may result in project suspension.

Termination

  • Either party may terminate the project agreement, provided written notice is given. Refunds will be handled as per the Refund Policy.

2. Privacy Policy

Information Collection

  • MARKS MEDIA collects essential personal information (name, email, phone) to facilitate communication, payments, and project delivery.
  • Information is collected only with the client’s consent and is limited to project needs.

Use of Information

  • Client information is used solely for project management, updates, and service delivery.
  • MARKS MEDIA may use aggregated, non-identifiable data for analytics to improve service quality.

Data Security

  • MARKS MEDIA implements industry-standard security measures to protect client information from unauthorized access, loss, or misuse.
  • Third-party services involved in payment processing or hosting also adhere to stringent data protection standards.

Client Rights

  • Clients have the right to access, correct, or delete their information at any time by contacting MARKS MEDIA.
  • MARKS MEDIA does not sell or share client information with third parties for marketing purposes.

3. Refunds and Cancellations Policy

Project Cancellation by Client

  • Deposit: The initial deposit is non-refundable once the project has begun.
  • Milestone Payments: Refunds for payments made towards completed milestones are non-refundable.
  • Uncompleted Milestones: For any uncompleted milestones, a partial refund may be issued based on work not yet delivered.

Project Cancellation by MARKS MEDIA

  • In the event that MARKS MEDIA must cancel the project, clients will receive a partial refund based on the work completed and delivered up to that point.

Scope Changes

  • Any additions or modifications outside the original scope will incur extra charges and are not refundable.

No Refunds for Completed Projects

  • Once a project is completed and approved, no refunds will be issued.

Maintenance and Support Services

  • Monthly maintenance and support fees are non-refundable once the service period begins.
